2.- Acceptance

This website and the service provided (from now on the Service) is available for any user. The Service is subject to the following terms and conditions: these Terms of Use, our Privacy Policy and Cookie Policy.

When you use the Service, you accept our terms and conditions. This way, you state that you won’t use the Service for an illegal purpose.

3.1.- Service

Doctor-abroad.eu is a website that promotes medical services from clinics and hospitals for foreign patients seeking medical treatment in Spain, facilitating access to these patients without any charge for the service provided. Patients will pay for their medical treatments directly at the clinics and hospitals, or through third parties, such as medical insurance with international coverage.

Steps in the process of providing our services:

1. The patient on the website, through the contact form, will request a specific medical treatment, providing medical information.

2. Our team will confirm receipt of all the information and will ask for more information if required, and will also contact the different medical teams to respond as soon as possible, with treatments and budgets, according to the assessment made.

3. We will send you all the information provided by the medical team that will perform the required treatment, with a budget.

4. The patient can choose to pay for the medical service or use medical insurance with international coverage, in which case the hospital or clinic must confirm acceptance of the same.

4. Once the treatment and budget have been accepted by the patient, the date for the proposed treatment will be arranged.

Through the Service you could be send to other websites by links.

However,  Doctor-abroad.eu  does not have control over those sites or its content. In fact, those sites are subject to its own terms and conditions. Therefore, Doctor-abroad.eu  does not take responsibility for the quality, veracity or accuracy of those sites.

5.- Age

In relation to the use and purchase of the Service, you state that you are an adult with full legal capacity to use this site according to its terms and conditions and be entailed by this agreement, that you accept entirely.

If you contract the Service on behalf of a company, you acknowledge that you have authorization and adequate representation on behalf of the organization to do so.

You state that all the information provided to access the Service, before and after its use, it’s complete, accurate and reliable.

6.- Intellectual and Industrial Property

The content and the information of this site (among other, data, text, sound, pictures or code), as well as the hardware and software used to provide the content and information are owned by Doctor-abroad.eu or according to the corresponding licenses.

In addition, the modification, reproduction, duplication, copy, distribution, sale, resale and other exploitation forms for commercial purposes of the Service are forbidden.  

For any other use of the content of the site, the prior and written consent from  Doctor-abroad.eu  will be required.

7.- Patient warnings

You should not use Video Consultations if you think your health problem is urgent or an emergency. 

Video consultations should not be used if you have a medical emergency, such as chest pain, severe abdominal pain, if you have lost consciousness, trouble breathing, among others.

If it is a medical emergency for you or someone by your side, you should call to emergency service.

At the time you make the reservation of the video consultation or telephone consultation, you have explicitly accepted the terms and conditions as well as the privacy policy.

International video consultations and telephone consultations can only be used to provide medical advice. Medical prescriptions, exams, treatments, among others, may not be prescribed or indicated outside the territory where the doctor legally practices.

Patients guarantee they are over 18 years old, and possess the legal right, capacity and ability, on your own behalf, to accept and agree to these terms and conditions. All information must be truthful.

On certain occasions we may carry out identity checks to verify that you are the patient who you say you are, as to show us your ID, if it does not show it, the medical consultation could be denied.

Doctor-abroad.eu  reserves the right to refuse access to the service.

8.- Video consultation and telephone consultation

Remote medical consultations, by chat, telephone or videos, will have limitations in terms of physical examination, diagnosis and treatment, as well as factors beyond the doctor and the patient such as internet, telephone coverage, sharpness of images that could be shared, noise third parties and the connection itself, being accepted by the user once the purchase of the service is confirmed, however the service provider may coordinate with the patient user another time, a new appointment in specific cases. 

For the service to be carried out, a good Internet connection will be necessary, it will be your responsibility to configure your computer and information technology programs to access the service.

Remote medical consultations will be carried out by Google meet and other tech supports, following the steps that will be indicated at the time of booking the appointment.

In the event that the medical service provider considers it, it will refer the patient user to medical centers and hospitals for a better diagnosis and treatment of the same.

Doctor-abroad.eu  is not an emergency medical service. Serious medical problems that can suppose a risk to the life of the patient should be referred to 112 or medical emergency medical services.

Video consultations are useful when people are seeking information about any health needs. Video can be useful in diagnosing some health problems and the Doctor you speak to on video can sometimes initiate treatment and investigations. It is not designed to be a complete health service and there will be occasions when the advice given in a video consultation will result in confirming the need to see a Doctor face to face.

9.- Responsibility

  • Doctor-abroad.eu  will not assume any liability arising from the provision of intermediation services between patient users and medical service providers, as well as any consequences arising from the use of the website by users.

Responsibility for Contracting the Service

  • 9.1. The website, Doctor-abroad.eu  and the patient undertake to comply with their legal and contractual obligations arising under this agreement, with the requirement that the user be over 18 years of age.
  • 9.2. The website, Doctor-abroad.eu  will not be liable in the event of not having certain services or treatments, offered by hospitals or clinics, through the website when this is due to force majeure, errors or actions or omissions attributable to the Hospitals or clinics.
  • 9.3. The website, Doctor-abroad.eu  will make every effort within its power to maintain the correct operation of the website with the information provided by hospitals and clinics.
  • 9.4. In all the aforementioned cases, beyond the control and due diligence of the website, Doctor-abroad.eu , the user will not be entitled to compensation for direct or indirect damages, or for loss of profits.

Responsibility for Medical Service

  • 9.5. The website, Doctor-abroad.eu  acts only as an intermediary between patients and medical service providers, hospitals and clinics, and therefore does not assume direct or indirect responsibility for the quality, safety, legality, or any other aspect related to the execution of the medical service provided. Full responsibility lies with the medical service provider, who must ensure the provision of services in accordance with applicable professional and ethical standards.
  • 9.6. The website, Doctor-abroad.eu   is exempt from all responsibility for delays, defective performance or non-compliance in the provision of medical assistance services, including but not limited to diagnosis, treatment and follow-up. Any claim arising from medical services received must be addressed directly to the medical service provider.
  • 9.7. The website, Doctor-abroad.eu   expressly excludes any liability for indirect, incidental, consequential, special or exemplary damages, including, but not limited to, damages for loss of profits, business interruption, loss of business information or personal injury related to, or in connection with, the use or inability to use the medical services, even if the website has been advised of the possibility of such damages.
  • 9.8. In situations of force majeure, such as armed conflicts, natural disasters, public health emergencies, strikes or any other circumstances beyond the reasonable control of the parties, including technological problems or information system failures, the website shall be exempt from any form of liability, to the extent that such situations affect the ability of the medical services provider to fulfill its obligations.Transfer of Personal Data

9.9. The Platform will carry out the transfer of the personal data of patient users to the medical service provider, being the information essential and strictly necessary for the indicated purpose. Provided that the user has explicitly accepted, once the medical service has been purchased. The medical service provider will process the information solely for the purpose of providing the medical assistance required by the patient user, with strict compliance with the data protection regulations applicable to the medical service provider, preserving and guaranteeing the confidentiality of such information.

9.10. The Platform ensures that all transfers of personal data from patient users to the medical service provider are carried out with the explicit consent of the user, and in strict compliance with the applicable laws and regulations on data protection. However, The Platform is not responsible for the processing of data once it has been transferred to the medical service provider.

10.- Changes and nullity

We can update the terms and conditions of the Service in the future, as well as the features and functionalities of it.

We will inform you about these changes by sending you a notification to the provided email address and/or through a notice about it in our website.

If any clause included in these terms and conditions is declared, totally or partially, invalid or ineffective, that nullity or inefficiency will only affect that clause or the part established as invalid. On everything else, these terms and conditions will persist.

17.- Complaints and actions derived from the contract

To the full extent permitted by law, this contract is regulated by Spanish law.

With the purpose to simplify any complaint through civil proceedings and to reduce costs, we do not exclude the possibility to be subjected to an equity arbitrage with the Chamber of Commerce and Industry.   

In this sense, and according to the applicable law, Doctor-abroad.eu  informs you of the existence of the European platform for online dispute resolution. This platform makes easier the extrajudicial resolution of disputes for online contracts between consumers and Internet service providers. The platform can be accessed through this website: http://ec.europa.eu/odr

If the Service is contracted by a company, in case of dispute, the parties submit to the courts of Palma of Majorca, and Spanish law.
